1. Who we are
IrishBuilds.com provides a searchable directory and alerts relating to new build developments in Ireland, with links to third-party sources.
2. Acceptance of these Terms
By accessing or using the Service, creating an account, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Service.
3. Eligibility
You must be at least 18 years old to use the Service.
4. What the Service is and is not
4.1 Information only
The Service provides general information and convenience features (search, filters, favourites, alerts). It is not professional advice.
4.2 No reliance
Do not rely on the Service as a substitute for legal, financial, property, surveying, planning, or investment advice. You are responsible for verifying all information with the original source and relevant professionals.
4.3 No agency
We are not an estate agent, broker, developer, lender, solicitor, surveyor, or planning authority, and we do not represent any third party.
5. Third-party sources, links, and content
5.1 Third-party links
Listings may include links to third-party websites ("Third-Party Sites"). We do not control them and are not responsible for their content, availability, accuracy, terms, or practices.
5.2 Third-party content and media
Any third-party text, images, logos, or metadata displayed (if any) remain the property of their respective owners. If you believe your rights are infringed, see Section 17 (Complaints and takedown).
5.3 No endorsement
A link or reference does not imply endorsement or affiliation.
6. Accounts and security
6.1 Account responsibility
You are responsible for keeping your login details secure and for all activity on your account.
6.2 Suspension
We may suspend or terminate accounts to protect the Service, enforce these Terms, or comply with law.
7. Subscriptions, billing, and access
7.1 Plans
The Service may offer monthly, yearly, and lifetime plans. Plan features and limits may be described on the checkout page or within your account.
7.2 Payment processor
Payments are processed by a third-party processor (for example Stripe). We do not store full card details.
7.3 Renewals
Monthly and yearly plans renew automatically unless cancelled through your account portal before the renewal date.
7.4 Lifetime plan
Lifetime access means access for the lifetime of the Service, not your lifetime. If the Service/holding company is discontinued, lifetime access ends.
7.5 Feature limits
Where limits apply (for example email alerts), you agree not to attempt to bypass them.
7.6 Taxes
Prices may include or exclude taxes depending on your location and applicable rules.
8. Refunds and cancellations
8.1 Digital service
Where allowed by law, fees are non-refundable once access is provided. If consumer law grants a right of withdrawal, you may be required to explicitly acknowledge loss of the right once the digital service begins.
8.2 Cancellation
You can cancel subscriptions via the billing portal. Cancellation stops future renewals; it does not retroactively refund prior charges unless required by law.
8.3 Chargebacks
Unjustified chargebacks may result in account suspension and recovery of costs.
9. Acceptable use
You agree not to:
- scrape, crawl, or harvest the Service or its data except where expressly allowed
- attempt to bypass paywalls, access controls, rate limits, or security
- upload malware or attempt to disrupt the Service
- use the Service for unlawful purposes
- reverse engineer or copy the Service except where permitted by law
10. Intellectual property
We own the Service, including our software, layout, and branding, excluding third-party marks and content. You receive a limited, non-transferable, revocable licence to use the Service for personal or internal business use.
11. Availability and changes
11.1 Availability
The Service is provided "as is" and "as available". We do not guarantee uninterrupted operation or that errors will be corrected immediately.
11.2 Changes
We may change, remove, or add features, listings, filters, or pricing at any time.
12. Disclaimers
To the maximum extent permitted by law:
- We make no warranties about accuracy, completeness, timeliness, or fitness for purpose.
- Listings may be incomplete, outdated, duplicated, incorrectly categorised, withdrawn, or inaccurate.
- We do not guarantee that any development exists, is available, or will be available.
13. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, consequential, special, punitive, or economic losses, including loss of profits, loss of opportunity, loss of data, business interruption, or reputational harm.
- Our total liability for any claim in any 12-month period is limited to the amount you paid us in that 12-month period. If you paid nothing, our liability is limited to EUR 50.
- Nothing in these Terms limits liability that cannot be excluded under law (for example death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).
14. Indemnity
You agree to defend, indemnify, and hold harmless IrishBuilds.com, its operators, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- your use of the Service
- your breach of these Terms
- your violation of any law or third-party right
- any content you submit, transmit, or publish through the Service
- your misuse of third-party links, images, or data accessed through the Service
15. User submissions
If you submit feedback, suggestions, or reports, you grant us a worldwide, royalty-free licence to use them to operate and improve the Service.
16. Termination
We may suspend or terminate your access immediately for breach, suspected abuse, risk, or legal compliance. Sections intended to survive (including limitation of liability and indemnity) survive termination.
17. Complaints and takedown
If you believe a listing or media on the Service infringes rights or is inaccurate, send a notice via our Contact page with:
- identification of the content
- the basis of the complaint
- your contact details
- evidence of rights or authority (if applicable)
We may remove or modify content at our discretion.
18. Governing law and disputes
These Terms are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction, subject to any mandatory consumer protection rights.
19. Changes to Terms
We may update these Terms. Continued use after changes means acceptance.
